2. Website Purpose

This website provides:

• SDA property marketing
• Information about Specialist Disability Accommodation
• Enquiry services for participants, families, landlords, support coordinators and providers
• Portal accounts for landlords, support coordinators and providers
• Marketing of SDA properties offered for sale (see clause 13.6)
• Business information regarding SDA services

The website does not provide medical, financial or legal advice.

3. Our Licences and Registrations

Accessibility Living Solutions Australia Pty Ltd, trading as Find My SDA, is a Registered Land Agent in South Australia (RLA 344702) and a registered NDIS Specialist Disability Accommodation provider.

Where we market or sell a property, we act as a licensed land agent. Any sale is handled under a separate written sales agency agreement with the vendor and in accordance with the Land and Business (Sale and Conveyancing) Act 1994 (SA), including the Form R7 Vendor's Statement. Nothing on this website is an offer to sell, a contract of sale, or financial or investment advice. Purchasers should make their own enquiries and obtain independent legal and financial advice.

4. No Guarantee of Placement

Find My SDA does not guarantee:

• Participant placement
• Property tenancy
• Funding approval
• Investment returns
• NDIS plan approvals

All decisions remain subject to NDIA processes and individual circumstances.

5. Sensitive Information Disclaimer

Users submitting NDIS or medical information acknowledge:

• Information is provided voluntarily
• It is used solely for accommodation assessment and compliance
• Accuracy of submitted information is the responsibility of the user

To the fullest extent permitted by Australian law:

• We are not liable for indirect or consequential losses
• We are not liable for reliance on website information

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot be excluded. Where our liability can lawfully be limited, it is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.

9. Acceptable Use

When using this website you must not:

• Submit false, misleading or fraudulent enquiries or listings

10. Governing Law & Severability

These Terms are governed by the laws of South Australia and the Commonwealth of Australia.

If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest of the Terms continue in full force.

11. Portal Accounts

Some parts of the website (such as the Landlord, Coordinator and Provider portals) require an account. Accounts are set up and approved by our team. You must:

• Keep your sign-in details secure and not share your account
• Only use an account for the role it was approved for
• Provide accurate information when requesting an account

You are responsible for activity under your account. We may suspend or close an account that breaches these Terms, acting reasonably.

12. Changes to Terms

We may update these Terms from time to time. We will publish the updated version here with a new "last updated" date. For active listings and portal accounts, we will give you reasonable notice of changes that affect you. If you do not agree with a change, you can delist your property or close your account.

13. Landlord & Provider Listing Terms

These terms apply when you submit a property through the Find My SDA Landlord Portal or otherwise ask us to list a property ("your listing"). They apply in addition to the terms above.

13.1 Your authority

By submitting a listing you warrant that you are the owner of the property, or that you are authorised by the owner (or hold another lawful right) to list, market and offer the property for tenancy.

13.2 Accurate information

All information, photos and documents you provide must be true, current and not misleading, consistent with your obligations under the Australian Consumer Law. You must promptly update your listing (or ask us to) when anything material changes, including availability.

13.3 Marketing licence

While your property is listed as available, you grant Accessibility Living Solutions Australia Pty Ltd a licence to market and advertise it, including publishing the property details and photos on this website, in our marketing channels and on social media, and to introduce prospective tenants, families, support coordinators and providers to it. This licence ends when the listing is removed, except that we may retain records for compliance purposes.

13.4 Our review and discretion

Nothing you submit appears publicly until we review and approve it. We may edit listings for style, clarity or compliance, and may decline, suspend or remove any listing at our discretion, acting reasonably.

13.5 Photography

An optional professional photoshoot is available for $500 plus GST, invoiced separately and payable within 14 days of invoice. Nothing is charged when you submit a listing. Photos we commission may be used by us and by you for the marketing of the property.

13.6 Our role and no guarantee

Find My SDA is a licensed real estate agent (RLA 344702) and a registered NDIS SDA provider. Depending on the service you choose, we may market and sell your property, help place tenants, or provide SDA services. We do not guarantee a tenant, a timeframe, a rent level or any funding outcome. You remain responsible for your own agreements and for the property's compliance with all applicable requirements, including SDA enrolment, NDIS rules and building and safety standards.

13.7 Fees

Listing a property is free unless we agree otherwise with you in writing. The only standard charge is the optional photoshoot in clause 13.5. For approved provider accounts, the first 10 concurrent listings are free; we will tell you in writing before any charge applies to further listings, and no charge applies unless you agree to it.

13.8 Your information

Your contact details are used to operate the service and are not shown publicly on your listing. Only the property information needed for marketing (such as address, features and photos) is published.

13.9 Responsibility for your materials

You are responsible for the accuracy of the information you provide and for having the rights to any photos or materials you upload, and you agree to cover us for claims that arise from inaccurate information, a lack of authority to list, or materials that infringe someone else's rights.

13.10 Updating and delisting

You can sign in to the Landlord Portal at any time to update your listing or ask for it to be removed, and we will action removals within a reasonable time.
